Service Agreement Contract:
By using any portion of Infotab (WHD) service, you are agreeing to this service agreement on this document entirely. Infotab (WHD) reserves the right to add, delete, or modify any provision of this Policy at any time without prior notice. URL: http://webhostingdomain.us/tos.html

1. Use of services
1.1 Infotab (WHD) servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: Pirated software, Hackers programs or archives, Warez sites, MP3, and IRC bots. The subscriber to Infotab service agrees to indemnify and hold harmless Infotab (WHD) from any claims resulting from the use of the service that damages the subscriber or any other party.

1.2 Sites We Do Not Host:
1. We do not allow hosting of adult, wares, illegal, hate content on our servers.

1.2. Backups:
1.2.1 Infotab (WHD) performs backups on all servers to ensure critical files are never lost. However Infotab (WHD) is NOT responsible for lost data, time, income or any other resource due to faulty backups or non-existant backups.

1.2.2 We strongly encourage all of our customers to do their own backups on their home computers or CD to ensure you have ready access to your data in the event, we should have a hardware failure. Although we regularly take backups of our server and we do not expect anything like this to occur, we want you to be prepared in the event that it does. Please kindly take backups of your all files.

1.2.3 Customers are responsible for maintaining their own backups on their own personal computers or other computers.

1.3 Resource Usage:

User May not:

Use 20% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
1.Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
2. Run any type of web spider on shared servers.
3. Run any software that interfaces with an IRC (Internet Relay Chat) network.
4. Run any bit torrent application, tracker, or client. Please note that you may link to torrents off server, but may not host or store them.
5. Participate in any file-sharing/peer-to-peer activities
6. Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
7. Run cron entries with intervals of less than 15 minutes
8. Use daily average system resources (CPU, RAM, MySQL) more than 1%

If any site do not follow above resource usage policies, Infotab (WHD) will have right to suspend the service.

1.4 Payment and Bills:

1.4.1 All accounts are set-up on a pre-pay basis only.
1.4.2 Infotab (WHD) will suspend your account if outstanding bills have not been paid in within 5 days.
1.4.3 Infotab (WHD) reserves the right to impose a re-activation fee for accounts that have been suspended

1.5 Refund Policy:

1.5.1. All hosting account comes with 30 days moneyback guaranteee.
1.5.2. Domain Registration is non refundable.
1.5.3. If you have received a free domain name then we will deduct $12.80 while refunding for hosting account.
1.5.4. If you have received a free SEO plan then we will deduct the SEO fees $149 before refunding the hosting account.

1.6 Marketing:
Customer agrees that during the term of this Agreement Infotab may publicly refer to Customer, orally and in writing, as a customer of Infotab Business Solutions.

1.7. Disclaimer:
Infotab (WHD) shall not be responsible for any damages your business may suffer. Infotab (WHD) makes no warranties of any kind, expressed or implied for services we provide. Infotab (WHD) disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Infotab (WHD) and its employees.
